摘 要
随着二维码技术的广泛应用，其便捷性在促进社会发展的同时，也为犯罪分子提供了新的作案手段。近年来，利用二维码实施的犯罪案件频发，涉及诈骗、盗窃、非法集资等多种类型，严重侵害了人民群众的财产安全和社会秩序稳定。文章概述了二维码犯罪案件的类型、特点及社会影响，通过分析司法认定的现状，指出当前在法律依据、司法解释、证据收集与认定以及司法人员能力等方面存在的诸多问题。针对上述问题，本文提出了完善二维码犯罪案件司法认定的对策。这些对策旨在构建更加科学、合理、高效的司法认定体系，为打击利用二维码犯罪提供有力支持，为推动相关立法的完善与司法实践的创新提供了重要参考。

Abstract
With the wide application of two-dimensional code technology, its convenience not only promotes social development, but also provides new means for criminals. In recent years, the use of two-dimensional code to implement criminal cases frequently, involving fraud, theft, illegal fundraising and other types, seriously infringed on the people's property security and social order stability. This paper summarizes the types, characteristics and social impact of two-dimensional code crime cases, and points out many problems in legal basis, judicial interpretation, evidence collection and identification, and the ability of judicial personnel by analyzing the current status of judicial determination. In view of the above problems, this paper puts forward countermeasures to improve the judicial identification of two-dimensional code crime cases. These countermeasures aim to build a more scientific, reasonable and efficient judicial identification system, provide strong support for combating crimes using two-dimensional code, and provide an important reference for promoting the improvement of relevant legislation and the innovation of judicial practice.
