核准追诉低龄未成年人刑事责任问题研究 -法学专业

摘要

近年来，随着社会环境的复杂化及信息技术的快速发展，低龄未成年人犯罪问题日益凸显，其刑事责任承担成为社会关注的焦点。本文围绕核准追诉低龄未成年人刑事责任问题展开研究，概述了低龄未成年人的定义、特征及刑事责任的特殊性，深入分析当前核准追诉低龄未成年人刑事责任的法律规定、实践操作、程序实施及效果评估，揭示了该领域存在的诸多问题，针对上述问题，本文提出了完善核准追诉低龄未成年人刑事责任的对策。这些对策旨在构建更加科学、合理、公正的核准追诉体系，以更好地应对低龄未成年人犯罪问题，保护社会公共利益与未成年人权益。本文通过对核准追诉低龄未成年人刑事责任问题的全面探讨，不仅揭示了当前存在的问题与挑战，还提出了切实可行的完善对策，为相关立法与司法实践提供了有益的参考与借鉴。

Abstract

In recent years, with the complexity of social environment and the rapid development of information technology, the problem of juvenile delinquency has become increasingly prominent, and its criminal responsibility has become the focus of social attention. This paper focuses on the issue of criminal responsibility of authorized prosecution of underage minors, Outlines the definition, characteristics and particularity of criminal responsibility of underage minors, makes an in-depth analysis of the current legal provisions, practical operations, procedure implementation and effect evaluation of authorized prosecution of underage minors, and reveals many problems in this field. This paper puts forward some countermeasures to perfect the criminal responsibility of the juvenile. These measures aim to build a more scientific, reasonable and fair system of approval and prosecution, so as to better deal with the problem of juvenile crimes and protect the social public interests and the rights and interests of minors. This paper not only reveals the existing problems and challenges, but also puts forward feasible and perfect countermeasures, which provides useful reference for relevant legislation and judicial practice.
