摘 要
随着电子商务的迅猛发展,电子消费合同日益普及,网络消费者知情权问题凸显。本研究旨在探讨电子消费合同中网络消费者的知情权及其保护机制,基于对现行法律法规、司法实践及电商平台运营模式的深入分析,采用文献研究法、案例分析法与比较研究法,剖析了当前我国网络消费者知情权面临的挑战,包括信息不对称、格式条款滥用、信息披露不充分等问题。研究发现,现有法律框架虽已初步构建起知情权保护体系,但在适应互联网交易特点方面仍存在不足,如缺乏针对性的立法规范、监管措施执行力度不够等。创新性地提出从完善立法、强化平台责任、优化信息披露机制三方面加强保护,建议制定专门的电子消费合同法规,明确平台在保障消费者知情权方面的义务,建立动态信息披露制度,确保消费者能够及时获取真实、全面的信息,以维护其合法权益,促进电子商务健康有序发展。

Abstract
With the rapid development of e-commerce, electronic consumer contracts have become increasingly prevalent, highlighting issues related to online consumers' right to information. This study aims to explore the right to information of online consumers in electronic consumer contracts and its protection mechanisms. Through an in-depth analysis of current laws and regulations, judicial practices, and e-commerce platform operating models, this research employs literature review, case analysis, and comparative studies to examine the challenges faced by online consumers in China, including information asymmetry, abuse of standard form contracts, and inadequate information disclosure. The findings indicate that while the existing legal fr amework has established a preliminary system for protecting the right to information, it still falls short in adapting to the characteristics of internet transactions, such as the lack of targeted legislation and insufficient enforcement of regulatory measures. Innovatively, this study proposes strengthening protection from three aspects: improving legislation, reinforcing platform responsibilities, and optimizing information disclosure mechanisms. It recommends establishing specific regulations for electronic consumer contracts, clarifying platforms' obligations in safeguarding consumers' right to information, and implementing a dynamic information disclosure system to ensure consumers can timely access accurate and comprehensive information, thereby protecting their legitimate rights and promoting the healthy and orderly development of e-commerce.
