摘 要
本文全面探讨了农村宅基地管理中面临的多维度问题,包括规划与管理机制的缺失、一户多宅与宅基地超标现象的普遍存在、宅基地分配过程中的不公平性以及宅基地使用中的违法行为等。这些问题不仅影响了农村土地的合理利用,也损害了农民的合法权益,阻碍了农村社会的和谐稳定。通过深入分析,本文揭示了农村宅基地管理问题的根源,包括管理体制的不健全、政策执行的不力、规划缺失导致的土地利用不合理、农民土地法制观念的淡薄以及宅基地管理制度与农村实际情况的脱节。这些问题的存在,使得农村宅基地管理陷入了困境,亟需有效的对策来加以解决。针对上述问题,本文提出了一系列切实可行的对策与建议。首先,加强宅基地的规划与管理,提高规划执行力度,引入公众参与和民主决策机制,并推行信息化管理平台,以提升管理效率。其次,严格控制一户多宅与宅基地超标现象,明确界定标准,加强户籍与土地使用权管理的联动,实施严格的面积限制与审查机制。再次,确保宅基地分配的公平合理,明确分配标准与原则,加强政策宣传与解读,完善分配程序与流程。最后,加强宅基地使用中的监管与执法,建立健全监管体系,明确监管职责与权限,加强动态监测与巡查,以遏制违法行为的发生。

RESEARCH ON PROBLEMS AND COUNTERMEASURES IN RURAL HOMESTEAD MANAGEMENT
ABSTRACT
This paper comprehensively discusses the multi-dimensional problems faced in the management of rural housing land, including the lack of planning and management mechanism, the common existence of multiple houses in one family and the phenomenon of exceeding the standard of housing land, the unfairness in the process of housing land distribution and the illegal behavior in the use of housing land. These problems not only affect the rational use of rural land, but also damage the legitimate rights and interests of farmers and hinder the harmony and stability of rural society. Through in-depth analysis, this paper reveals the root causes of rural land management problems, including the imperfect management system, the ineffective implementation of policies, the irrational land use caused by the lack of planning, the weak legal concept of farmers and the disconnection between the management system of rural land and the actual situation. The existence of these problems makes the management of rural homestead fall into a dilemma, and effective countermeasures are urgently needed to solve them. In view of the above problems, this paper puts forward a series of practical countermeasures and suggestions. First of all, strengthen the planning and management of homestead, improve the implementation of planning, introduce public participation and democratic decision-making mechanism, and implement information management platform to improve management efficiency. Secondly, strictly control the phenomenon of multiple houses and homestead exceeding the standard, clearly define the standard, strengthen the linkage between household registration and land use right management, and implement strict area restriction and review mechanism. Thirdly, ensure the fair and reasonable allocation of residential land, clarify the allocation standards and principles, strengthen the publicity and interpretation of policies, and improve the allocation procedures and processes. Finally, strengthen the supervision and law enforcement in the use of homestead, establish and improve the supervision system, clarify the supervision responsibilities and authority, strengthen dynamic monitoring and inspection, in order to curb the occurrence of illegal acts.
