摘要
本文深入探讨了夫妻财产制选择权的法律问题。首先，文章概述了夫妻财产制的基本概念、分类及其在现代家庭法中的重要地位。随后，文章分析了夫妻财产制选择权的理论基础，包括婚姻自由原则、平等原则和契约自由原则在其中的应用。在比较国内外立法差异的基础上，文章指出了我国夫妻财产制选择权立法存在的问题，并探讨了其对司法实践的影响。针对夫妻财产制选择权行使中的常见问题，本文提出了具体的完善建议。对于夫妻双方意见不一致的情况，建议加强沟通与协商，并引入第三方调解机制；针对缺乏明确法律指导的问题，文章呼吁完善相关法律法规，并加强法律宣传与教育；针对未充分考虑第三方利益的问题，文章建议明确告知义务，建立公示制度，并加强监管与审查；针对执行难度大的问题，文章提出了明确权利义务、建立监督机制以及加强法律救济等对策。通过深入分析夫妻财产制选择权的法律问题，本文旨在为完善我国夫妻财产制选择权立法提供参考，以更好地维护夫妻双方的财产权益，促进家庭和谐稳定。同时，文章也提醒社会各界关注夫妻财产制选择权的法律问题，共同推动相关制度的完善与发展。

Abstract
This paper discusses the legal issue of marital property system option. First, the article outlines the basic concepts and classification of the marital property system and its important position in modern family law. Subsequently, the paper analyzes the theoretical basis of the marital property system choice, including the application of the principle of freedom of marriage, equality and freedom of contract. On the basis of comparing the differences between domestic and foreign legislations, this paper points out the problems existing in the legislation of marital property system option in China, and discusses its influence on judicial practice. In view of the common problems in the exercise of marital property system, this paper puts forward specific suggestions. In the case of disagreement between husband and wife, it is suggested to strengthen communication and consultation and introduce the third-party mediation mechanism; for the lack of clear legal guidance, the article calls for the improvement of relevant laws and regulations, and strengthening legal publicity and education; for the problems of not considering the interests of the third party, establish the publicity system, and strengthen supervision and review; for the countermeasures of clarifying rights and obligations, establishing supervision mechanism and strengthening legal relief. Through in-depth analysis of the legal issues of marital property system choice, this paper aims to provide reference for improving the legislation of marital property system option in China, so as to better safeguard the property rights and interests of both husband and wife and promote family harmony and stability. At the same time, the article also reminds all sectors of society to pay attention to the legal issues of the choice of marital property system, and jointly promote the improvement and development of relevant systems.
