探讨工伤保险法律制度的现存问题及解决方法
摘 要：文章在分析我国工伤保险立法现状及存在问题的基础上，提出了我国工伤保险立法改革的一系列措施，主要包括：工伤认定标准及法定程序的改革，工伤赔偿标准及适用范围的改革。在此基础上，本文还通过对一些具体案例的分析，对如何处理这些问题进行了探讨。本文力图对目前对工伤保险法律制度的研究状况及存在的问题进行系统地梳理，以期能给有关决策者及实务界带来一些有益的启示，从而提高我国工伤保险法律制度的效力及科学性。在我国，工伤保险是一种新型的劳动保障，也是一种新型的劳动保障。同时，新的职业病也在不断出现，这就需要对工伤认定的标准、程序进行相应的改革。与此同时，随着互联网技术的发展，以及大数据的广泛应用，使得工伤保险的风险与管理变得更加复杂。所以，在今后的工作中，还需要不断地加大对工伤保险法律体系的研究力度，不断地对其进行完善，从而使其能够更好地保护劳动者，提高企业的发展质量。

Discuss the existing problems and solutions of the legal system of industrial injury insurance
Abstract：On the basis of analyzing the current situation and existing problems of China's industrial injury insurance legislation, this paper puts forward a series of measures for the legislative reform of industrial injury insurance in China, mainly including: the reform of the standard of industrial injury identification and legal procedures, the reform of industrial injury compensation standard and the scope of application. On this basis, this paper also discusses how to deal with these problems through the analysis of some specific cases. This paper tries to systematically sort out the current research situation and existing problems of the legal system of industrial injury insurance, in order to bring some useful enlightenment to the relevant decision makers and practical circles, so as to improve the effectiveness and scientificity of the legal system of industrial injury insurance in China. In our country, industrial injury insurance is a new kind of labor security, but also a new type of labor security. At the same time, new occupational diseases are also appearing constantly, which requires the corresponding reform of the standards and procedures of industrial injury identification. At the same time, with the development of Internet technology and the wide application of big data, the risk and management of industrial injury insurance have become more complicated. Therefore, in the future work, it is necessary to continuously increase the research of the legal system of industrial injury insurance, and constantly improve it, so that it can better protect workers and improve the quality of the development of enterprises.
