摘 要
我国城镇化加速推进,农村集体建设用地入市成为土地制度改革的关键。本研究针对入市的制度障碍和实践问题,探索一条适合中国国情的入市路径。通过文献分析、案例研究和比较研究,系统分析了国内外研究成果和广东南海、浙江德清等地区的实践,借鉴了德国、日本的土地管理制度。研究指出,入市关键在于建立政府引导、市场主导、农民参与的协同机制,具体路径包括完善法律法规、明确产权归属、建立交易平台、规范流转程序、健全收益分配机制、保障农民权益、创新金融支持方式。研究创新地提出渐进式改革和差异化推进策略,强调因地制宜制定政策,并构建了风险防控、利益协调、制度保障的配套机制。研究结论显示,入市能激活农村土地资源、增加农民收入、缓解城市建设用地矛盾,促进城乡融合。

ANALYSIS OF THE MARKET ENTRY PATH OF RURAL COLLECTIVE CONSTRUCTION LAND
ABSTRACT
China's urbanization is accelerating, and the entry of rural collective construction land has become the key to land system reform. This study explores the institutional obstacles and practical problems, and explores a path suitable for China's national conditions. Through literature analysis, case study and comparative study, the paper systematically analyzes the research results at home and abroad and the practices of Guangdong Nanhai and Deqing of Zhejiang province, and draws on the land management system of Germany and Japan. The research points out that the key to entering the market is to establish a cooperative mechanism of government guidance, market leadership and farmers 'participation. The specific paths include improving laws and regulations, clarifying the ownership of property rights, establishing a trading platform, standardizing the circulation procedures, improving the income distribution mechanism, protecting farmers' rights and interests, and innovating the financial support methods. Research and innovatively put forward gradual reform and differentiated promotion strategies, emphasized the formulation of policies according to local conditions, and built a supporting mechanism of risk prevention and control, interest coordination and institutional guarantee. The conclusion shows that entering the market can activate rural land resources, increase farmers' income, alleviate the contradiction of urban construction land, and promote urban-rural integration.
