在工程项目实施过程中,工程索赔作为解决合同履行过程中因各种原因导致的经济损失的重要手段,其处理效果直接关系到工程项目的成本控制、工期管理及合作关系。随着工程项目规模的不断扩大和复杂性的增加,工程索赔问题日益凸显,成为工程项目管理中不可忽视的重要环节。工程索赔的处理不仅涉及法律、经济、技术等多个领域,还直接关系到工程项目的经济效益和各方利益。本研究旨在探讨工程索赔处理中的争议问题及其解决策略。首先,对工程索赔的基本概念、索赔管理流程以及索赔解决途径进行了概述。其次,分析了工程索赔对工程项目在成本控制、工期管理及合作关系等方面的影响。在此基础上,重点探讨了工程索赔处理中的争议问题,包括索赔原因认定争议、赔偿金额计算争议、证据提供与审核争议以及索赔程序执行争议等。针对这些争议问题,本研究提出了相应的解决策略,包括明确责任归属与事件界定、统一赔偿金额计算标准、强化证据管理与审核机制以及优化索赔程序与执行监督等。这些策略旨在提高工程索赔处理的效率和公正性,减少争议的发生,为工程项目的顺利进行提供有力保障。本研究成果对于完善工程项目管理体系、提升工程项目管理水平具有重要的理论意义和实用价值。

Abstract
In the process of project implementation, project claim is an important means to solve the economic losses caused by various reasons in the process of contract performance, and its treatment effect is directly related to the cost control, time period management and cooperation relationship of the project. With the continuous expansion of project scale and the increase of complexity, the problem of project claim is increasingly prominent and has become an important link that cannot be ignored in project management. The handling of engineering claims not only involves legal, economy, technology and other fields, but also directly related to the economic benefits of the project and the interests of all parties. The purpose of this study is to explore disputes in engineering claims handling and their resolution strategies. First, the basic concepts of engineering claims, claims management process and the claims solution pathway are outlined. Secondly, the influence of engineering claims on cost control, duration management and cooperation relationship is analyzed. On this basis, the paper focuses on the disputes in the settlement of project claims, including the determination of claim reason, the calculation of compensation amount, the evidence provision and audit, and the execution of claim procedure. In view of these disputes, this research puts forward the corresponding solution strategies, including clarifying the definition of responsibility and event, unifying the calculation standard of compensation amount, strengthening the evidence management and audit mechanism, and optimizing the claim procedure and implementation supervision. These strategies aim to improve the efficiency and impartiality of engineering claims processing, reduce the occurrence of disputes, and provide a strong guarantee for the smooth progress of the project. The research results have important theoretical significance and practical value for improving the project management system and improving the project management level.
