本文全面探讨了农村集体经营性建设用地入市的问题,旨在为该领域的政策制定与实际操作提供理论支持与实践指导。首先,本文概述了农村集体经营性建设用地入市的研究背景,指出随着城市化进程的加快和农村土地制度改革的深化,农村集体经营性建设用地入市成为促进城乡融合发展的重要途径。随后,本文详细分析了当前入市过程中存在的四大主要问题:法律与政策层面的不明确和滞后、市场机制的不完善导致资源配置效率低下、农民权益保障机制的缺失以及管理和监管体系的不健全。针对上述问题,本文提出了系统的对策建议。在法律与政策层面,建议完善相关法律法规,明确土地权属关系,建立公平的入市审批机制,并优化土地征收补偿制度。在市场机制方面,主张设立专门的土地交易平台,完善价格发现机制,确保交易公开透明。同时,本文强调需强化农民权益保障,通过完善农民参与决策机制、建立收益公平分配制度以及加强农民权益信息告知与教育,确保农民在入市过程中获得合理收益。最后,本文提出应构建多层次监管体系,完善土地使用监管机制,并加大对违法违规行为的惩处力度,以维护市场秩序和公共利益。

RESEARCH ON THE PROBLEM OF MARKET ENTRY OF RURAL COLLECTIVE COMMERCIAL CONSTRUCTION LAND
ABSTRACT
This paper comprehensively discusses the problem of the market of rural collective management construction land, aiming at providing theoretical support and practical guidance for the policy formulation and practical operation in this field. First of all, this paper summarizes the research background of rural collective commercial construction land entering the market, and points out that with the acceleration of urbanization and the deepening of rural land system reform, rural collective commercial construction land entering the market has become an important way to promote urban-rural integration. Then, this paper analyzes four major problems in the current market entry process in detail: the unclear and lagging of laws and policies, the imperfect market mechanism leading to low efficiency of resource allocation, the lack of farmers' rights and interests protection mechanism, and the imperfect management and supervision system. In view of the above problems, this paper puts forward systematic countermeasures and suggestions. At the legal and policy level, it is suggested to improve the relevant laws and regulations, clarify the land ownership relationship, establish a fair market approval mechanism, and optimize the land expropriation compensation system. In terms of market mechanism, it is advocated to set up a special land trading platform, improve the price discovery mechanism, and ensure that the transaction is open and transparent. At the same time, this paper emphasizes the need to strengthen the protection of farmers' rights and interests, through improving the decision-making mechanism of farmers' participation, establishing a fair income distribution system, and strengthening the information and education of farmers' rights and interests, to ensure that farmers get reasonable benefits in the process of entering the market. Finally, this paper proposes to build a multi-level supervision system, improve the land use supervision mechanism, and increase the punishment for violations of laws and regulations, in order to maintain market order and public interests.
