消费者权益保护法的问题研究
摘要
本研究通过深入剖析消费者权益保护法的理论基础、立法目的、作用及核心原则,全面审视了消费者权益保护法的现实挑战与完善对策。研究梳理了消费者权益保护的法学理论,包括信息不对称理论和公平交易理论,揭示了保护消费者权益的重要性和紧迫性。在此基础上,研究进一步探讨了消费者权益保护法的立法目的,即保护消费者权益和促进市场经济健康发展,以及该法在市场秩序维护和消费者利益保障方面的积极作用。还聚焦了消费者权益保护法的核心原则,包括公平交易原则、知情权原则、选择权原则和安全权原则,这些原则是消费者权益保护法的基石,也是衡量消费者权益保障水平的重要标准。然而,研究也发现消费者权益保护法面临着诸多挑战,针对这些挑战,本研究提出了相应的完善对策,这些对策旨在提升消费者权益保护法的实效性和可操作性,为构建更加公平、透明、安全的消费环境提供有力保障。本研究旨在通过对消费者权益保护法的全面研究,为完善相关法律法规、提升消费者权益保障水平提供理论支持和政策建议,促进消费者权益保护工作的不断进步和发展。

Abstract
Through in-depth analysis of the theoretical basis, legislative purpose, function and core principles of the consumer rights and interests protection law, this study comprehensively examines the practical challenges and countermeasures of the consumer rights and interests protection law. This paper studies the legal theories of consumer rights protection, including information asymmetry theory and fair trade theory, and reveals the importance and urgency of consumer rights protection. On this basis, the research further discusses the legislative purpose of the law of consumer rights and interests, that is, to protect the rights and interests of consumers and promote the healthy development of the market economy, and the positive role of the law in the maintenance of market order and the protection of consumer interests. It also focuses on the core principles of the consumer rights and interests protection law, including the principle of fair trading, the principle of the right to know, the principle of choice and the principle of the right to safety, which are the cornerstone of the consumer rights and interests protection law and an important standard to measure the level of consumer rights and interests protection. However, the study also found that the protection law of consumer rights and interests is faced with many challenges, in response to these challenges, this study proposed corresponding countermeasures, which are aimed at improving the effectiveness and operability of the protection law of consumer rights and interests, and provide a strong guarantee for the construction of a more fair, transparent and safe consumption environment. The purpose of this study is to provide theoretical support and policy suggestions for improving relevant laws and regulations and enhancing the protection level of consumer rights and interests through a comprehensive study on the protection law of consumer rights and interests, and promote the continuous progress and development of consumer rights and interests protection.

Abstract
