夫妻离婚时房产分割的法律问题研究
本文深入探讨了夫妻离婚时房产分割的法律问题。在当前社会，离婚率逐年上升，而房产作为夫妻共同财产的重要组成部分，其分割问题愈发复杂。本文首先分析了夫妻离婚房产分割的法律基础，包括房产分割的基本原则、法律依据以及具体标准。接着，文章详细讨论了房产分割中面临的主要挑战，如婚前与婚后财产界定困难、房产登记与实际使用不一致、司法实践中的不统一、以及父母出资购房的产权归属争议等问题。为应对这些挑战，本文提出了相应的解决策略。针对婚前与婚后财产界定困难，建议通过明确界定标准和加强证据收集来解决；对于房产登记与实际使用不一致的问题，提出完善登记制度和强化公示制度的建议；在解决司法实践中的不统一方面，文章建议加强司法解释、推广典型案例以及加强法官培训；最后，对于父母出资购房的产权归属争议，提出明确出资性质、保留出资证据以及考虑公平原则的策略。本文的研究不仅有助于完善夫妻离婚房产分割的法律制度，也为司法实践提供了有益的参考。通过深入分析和探讨这些问题，本文旨在为离婚夫妻的财产分割提供更加公正、合理和有效的解决方案，维护家庭和谐与社会稳定。

Abstract
This paper deeply discusses the legal issues of property division when the couple divorces. In the current society, the divorce rate is increasing year by year, and the real estate as an important part of the joint property, the division of which is becoming more and more complex. This paper first analyzes the legal basis of divorce property separation, including the basic principles, legal basis and specific standards of property separation. Then, the article discusses in detail the main challenges in the division of property, such as the difficulty in defining property before and after marriage, the inconsistency between property registration and actual use, the inconsistency in judicial practice, and the dispute over the ownership of parents. To meet these challenges, this paper proposes corresponding solution strategies. In view of the difficulty in defining the property before marriage and after marriage, it is suggested to define the standard and strengthen the evidence collection; improve the inconsistency between the property registration and the actual use and strengthen the publicity system; solve the problem of the judicial practice and promote the typical cases and strengthen the training of judges. The study of this paper not only helps to improve the legal system of divorce property division, but also provides a useful reference for judicial practice. Through in-depth analysis and discussion of these problems, this paper aims to provide a more fair, reasonable and effective solution for the property division of divorced couples, and maintain family harmony and social stability.
