摘 要
本文的主要研究课题是“劳动法背景下的雇主侵权责任研究”，旨在从法律角度探究劳动法下雇主侵权责任制度，分析适用中的关键问题，探索雇主侵权责任制度的追溯与赔偿等方面。本文分为五个章节，主要包括劳动法中的侵权责任制度概述、雇主侵权责任的实质与构成要件、劳动法下的雇主侵权责任的适用、雇主侵权责任的追溯与赔偿以及实证研究等方面，通过文献法、调查访问法、比较法以及实证研究法等多种研究方法进行深入探究。经过研究，本文得出了结论：雇主侵权责任制度实施存在问题，需要完善；雇主侵权责任证明难度大，需要降低；雇主侵权赔偿金额偏低，需要提高。本文的创新之处在于深入细致地研究了劳动法下的雇主侵权责任制度，提出可操作性强的对策建议，对完善我国劳动法律制度具有一定的参考价值。

Abstract
The main research topic of this article is "Employer Liability for Tort under the Background of Labor Law". The aim is to explore the employer's tort liability system under labor law from a legal perspective, analyze key issues in its application, and investigate the retrospective and compensation aspects of employer's tort liability system. The article is divided into five chapters, including an overview of tort liability system in labor law, the essence and constitutive elements of employer's tort liability, the application of employer's tort liability under labor law, retrospective and compensation of employer's tort liability, and empirical research. The article employs various research methods such as literature review, survey, comparative law, and empirical research. The conclusion drawn from the study is that the implementation of the employer's tort liability system has problems and needs improvement. It is difficult to prove employer's tort liability and it is necessary to lower this difficulty. Employer's tort compensation amount is low and needs to be increased. The innovation of this article lies in the in-depth study of the employer's tort liability system under labor law, and presents practical suggestions for improvement, which has reference value for perfecting China's labor legal system.
