重庆市环保行政处罚法律制度研究
摘 要
本文以重庆市环保行政处罚法律制度为研究对象，旨在探究重庆市环保行政处罚法律制度的现状和存在的问题，并提出完善建议。本文采用文献资料法、案例分析法等方法，对重庆市环保行政处罚法律制度的法律框架、机构设置、案例进行了详尽的探讨。研究发现，在重庆市环保行政处罚法律制度中，法律框架、法规体系等方面还存在不足，机构设置不够完善，导致行政处罚效果不佳。此外，在具体行政处罚实践中，也出现了一些值得深思的案例，表明了环保行政处罚在具体实践中还存在较大的挑战。因此，加强法律与实践的紧密结合，探讨合理的行政处罚制度设计、机构设置和合理的处罚路径、方式、程度，有助于提升环保治理效果。本文提出了完善重庆市环保行政处罚法律制度的建议，包括加强法律宣传和执法力度，优化行政处罚流程，增强监管部门的行政处罚能力。这些建议都有助于提升环保治理效果，进一步加强了重庆市环保行政处罚的国际化水平和能力。

Abstract
This article takes the legal system of environmental administrative penalties in Chongqing as the research ob ject, aiming to explore the current situation and existing problems of the legal system of environmental administrative penalties in Chongqing, and propose suggestions for improvement. This article uses methods such as literature review and case analysis to explore in detail the legal fr amework, institutional settings, and cases of the environmental protection administrative punishment legal system in Chongqing. Research has found that there are still shortcomings in the legal fr amework, regulatory system, and other aspects of the environmental protection administrative punishment legal system in Chongqing, with inadequate institutional settings, resulting in poor administrative punishment effectiveness. In addition, there have been some thought-provoking cases in the practice of specific administrative penalties, indicating that environmental administrative penalties still face significant challenges in specific practices. Therefore, strengthening the close integration of law and practice, exploring reasonable administrative penalty system design, institutional settings, and reasonable penalty paths, methods, and degrees can help improve the effectiveness of environmental protection governance. This article proposes suggestions for improving the legal system of environmental protection administrative penalties in Chongqing, including strengthening legal publicity and enforcement efforts, optimizing administrative penalty processes, and enhancing the administrative penalty capacity of regulatory authorities. These suggestions help to improve the effectiveness of environmental governance and further strengthen the internationalization level and ability of environmental administrative penalties in Chongqing..
