消费信用与消费者权利保护

摘  要
信贷消费作为世界经济活动的一种主要消费方式,在发达国家的国民经济中占有举足轻重的地位。信贷消费是一种满足居民日常生活需求的新型信贷消费方式。此外,由于政府鼓励废除“福利分配”,也在一定程度上影响着人们的消费观念。我国居民的资金需求不断增加,促进了我国消费信贷业务的快速发展,也促进了我国金融业的快速发展。由此,信贷消费在我国迅速发展。但是,在我国的信贷消费中,消费者的合法权利受到侵害的情况时有发生,这种情况与我国的信贷消费非常不相适应。对此,我国应加强对失信行为的关注,健全相关制度,以保障失信主体的合法权利。消费信贷经济的发展,必然要求消费者权益得到保障,并在消费信贷中享有一般的信贷权利和各种特定的权益。对《消费信用法》与民法、商事法、经济法的关系进行了深入的剖析,并在此基础上,制订《消费信用法》,使消费者的利益得到充分的反映,同时也能更好地体现消费者的利益。

Abstract
Credit consumption, as a major consumption mode in the world economic activities, plays an important role in the national economy of developed countries. Credit consumption is a new type of credit consumption to meet the daily needs of residents. In addition, because the government encourages the abolition of "welfare distribution", it also affects people's consumption concept to a certain extent. The increasing capital demand of Chinese residents has promoted the rapid development of China's consumer credit business, as well as the rapid development of China's financial industry. As a result, credit consumption has developed rapidly in China. However, in China's credit consumption, the legitimate rights of consumers have been violated from time to time, which is very incompatible with China's credit consumption. In this regard, China should pay more attention to dishonesty and improve relevant systems to protect the legitimate rights of dishonest subjects. With the development of consumer credit economy, consumers' rights and interests must be guaranteed, and they should enjoy general credit rights and various specific rights and interests in consumer credit. The relationship between the Consumer Credit Law and civil law, commercial law and economic law is deeply analyzed. On this basis, the Consumer Credit Law is formulated to fully reflect the interests of consumers and better reflect the interests of consumers.
