小区车位车库的归属问题研究
摘 要
随着我国经济的发展,越来越多的人拥有了自己的汽车,小区的停车场和停车场越来越紧张,停车场的所有权也越来越多。目前,我国许多大城市都在关注着停车问题,因此,笔者对此进行了探讨。随着物质条件的日益改善,车辆的增多,停车问题日益严重,对停车的需求日益增加,土地资源日益匮乏,物价也日益昂贵,人们不得不向地下索取更多的空间,因此,大量的地下停车场出现,并且逐渐扩大。文章从停车泊位的定性和分类入手,对停车泊位的法律属性及学界的看法进行了分析。本文在分析国内外有关法律、法规、司法解释、司法实践的基础上,并根据《物权法》74条的有关规定,就如何处理物业管理中的停车泊位问题,提出若干意见。

Research on the ownership of parking garage in residential area
Abstract
With the development of China's economy, more and more people have their own cars. The parking lot and parking lot in the community are becoming more and more tense, and the ownership of the parking lot is also increasing. At present, many big cities in China are paying attention to the parking problem, so the author has discussed this. The article starts with the qualitative and classification of parking spaces, and analyzes the legal attributes of parking spaces and academic views. Based on the analysis of relevant laws, regulations, judicial interpretations and judicial practices at home and abroad, and in accordance with the relevant provisions of Article 74 of the Property Law, this paper puts forward some suggestions on how to deal with the parking problem in property management..
