摘 要
数字时代的到来使政府数据开放成为推动社会治理现代化和数字经济发展的关键驱动力，但其边界划定与伦理困境却日益凸显，亟需系统性研究。本研究以政府数据开放为核心议题，旨在探讨其合理边界及伦理挑战，并提出相应的治理框架。研究采用多学科交叉方法，结合规范分析与实证研究，通过案例剖析、问卷调查和专家访谈等方式，深入考察国内外政府数据开放的实践模式及其潜在风险。研究发现，政府数据开放在促进透明度提升和资源利用的同时，也面临隐私保护不足、数据滥用和技术鸿沟等多重困境。基于此，本文创新性地提出了“分级分类开放”理念，构建了包含技术保障、法律规制和社会参与的综合治理体系。这一框架不仅为政府数据开放提供了科学依据，还有效平衡了效率与安全之间的张力。研究的主要贡献在于填补了现有理论中关于数据开放边界的空白，并为相关政策制定提供了可操作性的建议，从而助力实现数字时代政府治理能力的全面提升。

Abstract
The advent of the digital era has made government data openness a critical driver for advancing the modernization of social governance and the development of the digital economy. However, the demarcation of its boundaries and associated ethical dilemmas have become increasingly prominent, necessitating systematic research. This study focuses on government data openness, aiming to explore its reasonable boundaries and ethical challenges while proposing an appropriate governance fr amework. A multidisciplinary approach is adopted, integrating normative analysis with empirical research, utilizing methods such as case analysis, questionnaire surveys, and expert interviews to comprehensively examine domestic and international practices of government data openness and their potential risks. The findings indicate that while government data openness enhances transparency and resource utilization, it also encounters multiple challenges, including insufficient privacy protection, data misuse, and technological divides. In response, this paper innovatively introduces the concept of "tiered and categorized openness," establishing a comprehensive governance system that incorporates technical safeguards, legal regulation, and social participation. This fr amework not only provides a scientific basis for government data openness but also effectively balances the tension between efficiency and security. The primary contribution of this research lies in addressing the theoretical gap regarding the boundaries of data openness and offering operational recommendations for relevant policy formulation, thereby facilitating the comprehensive enhancement of governmental governance capabilities in the digital age.
