摘 要：随着社会变迁和家庭观念的多元化，夫妻忠实义务的法律界定与责任承担成为婚姻法研究中的重要议题。本研究基于我国现行婚姻法律框架，结合司法实践案例，探讨夫妻忠实义务的内涵、外延及其法律责任的认定标准。通过文献分析与实证研究相结合的方法，本文系统梳理了国内外相关理论与立法经验，并对我国现行法律规范中存在的模糊性与操作性不足问题进行剖析。研究表明，现行法律对夫妻忠实义务的规定较为原则化，缺乏具体执行依据，导致司法实践中存在裁量不一致的现象。为此，本文提出明确忠实义务的法律边界，构建多层次的责任承担机制，并引入婚前协议等补充性制度安排，以增强法律适用的灵活性与适应性。本研究的创新点在于将伦理价值与法律规范有机结合，为完善我国婚姻法律体系提供了可行路径，同时为司法实践提供了更具操作性的参考方案，有助于促进婚姻关系的稳定与和谐发展。

Abstract：With the social transformation and diversification of family concepts, the legal definition of spousal fidelity obligations and the associated responsibilities have become significant issues in matrimonial law research. This study examines the connotation, extension, and criteria for legal responsibility regarding spousal fidelity obligations within the fr amework of China's current matrimonial laws, incorporating judicial practice cases. By combining literature analysis with empirical research, this paper systematically reviews relevant theories and legislative experiences both domestically and internationally, while analyzing the ambiguities and operational deficiencies in China's existing legal norms. The findings indicate that the current legal provisions on spousal fidelity obligations are relatively generalized, lacking specific enforcement bases, which leads to inconsistent judicial discretion in practice. To address these issues, this study proposes clarifying the legal boundaries of fidelity obligations, establishing a multi-level mechanism for responsibility allocation, and introducing supplementary institutional arrangements such as prenuptial agreements to enhance the flexibility and adaptability of legal application. The innovation of this study lies in integrating ethical values with legal norms, providing feasible pathways to improve China's matrimonial legal system, and offering more operational reference solutions for judicial practice, thereby contributing to the stability and harmonious development of marital relationships.
