平台经济网约工劳动关系认定困境与对策探究

摘  要：本文以平台经济网约工劳动关系认定为研究对象，首先概述了平台经济理论、劳动关系理论和治理理论等相关理论基础，为后续研究提供了坚实的理论支撑。随后，文章分析了平台经济网约工劳动关系认定的重要性，指出其对于保障网约工权益、促进平台经济规范发展以及维护社会稳定与和谐的重要作用。在此基础上，文章深入剖析了平台经济网约工劳动关系认定面临的四大困境：法律界定模糊、证据收集困难、主体关系复杂以及利益冲突与博弈，并详细阐述了各困境的具体表现及成因。针对上述困境，文章提出了相应的治理对策，包括完善法律法规体系以明确劳动关系认定标准、强化证据收集与保全机制以提高认定效率、厘清主体关系并优化用工模式以平衡各方利益、加强监管与自治的协同以构建良好的治理环境等。本文的研究旨在为平台经济网约工劳动关系认定提供有效的参考和借鉴，促进平台经济健康有序发展。

Research on the dilemma and countermeasures of labor relations in platform economic network

Abstract：This paper takes the identification of labor relations in the platform economy network as the research ob ject, and first summarizes the relevant theoretical basis of the platform economy theory, labor relations theory and governance theory, which provides a solid theoretical support for the subsequent research. Subsequently, the article analyzes the importance of the identification of labor relations, and points out its important role in protecting the rights and interests of platform workers, promoting the standardized development of platform economy and maintaining social stability and harmony. On this basis, this paper deeply analyzes the four difficulties faced by the identification of labor relations in the platform economy network: fuzzy legal definition, difficult evidence collection, complex subject relationship, interest conflict and game, and expounds the specific manifestations and causes of each dilemma in detail. In view of the dilemma, the article puts forward the corresponding countermeasures, including perfecting the laws and regulations system to clear labor relations standards, strengthen evidence collection and preservation mechanism to improve the efficiency, clarify the subject relationship and optimize the employment mode to balance the interests of all parties, strengthen supervision and autonomy of coordination to build a good governance environment, etc. The purpose of this paper is to provide effective reference for the identification of labor relations of platform economy network and promote the healthy and orderly development of platform economy.
