医疗事故侵权证明责任分配问题研究

摘要：本文旨在研究医疗事故侵权责任证明和责任分配问题。首先，通过对侵权责任原理及其种类的介绍，分析了医疗事故侵权责任原则及其证明难点。然后，针对医疗事故侵权责任证明的难点，提出了一些解决方案，包括事实证明、因果关系证明和过错证明。最后，通过对医疗事故侵权责任的分配问题的研究，探讨了法律规定的分配原则和依据实际情况的分配原则，并以实际案例为例进行分析，提出了合理的责任分配方案。本文旨在为医疗事故侵权责任的证明和分配提供一些有益的参考，以帮助相关机构和人员更好地处理医疗事故侵权责任问题。

Abstract:The purpose of this paper is to study the problem of proof and distribution of tort liability for medical malpractice. First of all, through the introduction of the principle and types of tort liability, it analyzes the principle of tort liability for medical malpractice and the difficulties in proving it. Then, in view of the difficulty of proof of tort liability for medical malpractice, this paper puts forward some solutions, including proof of fact, proof of causality and proof of fault. Finally, through the study of the distribution of tort liability for medical malpractice, the author discusses the distribution principle stipulated by law and the distribution principle based on the actual situation, and analyzes the actual case, and puts forward a reasonable distribution scheme of liability. The purpose of this paper is to provide some useful references for the proof and distribution of tort liability for medical malpractice, so as to help relevant institutions and personnel better deal with the problem of tort liability for medical malpractice.
