未婚同居法律问题研究
摘要：本文围绕未婚同居法律问题展开研究。首先，明确了未婚同居的定义、形式、法律地位和权利义务。其次，探讨了未婚同居关系中重要的财产和债务问题，以及常见的意外伤害、晚年经济保障、家庭暴力和子女抚养等权利义务问题。接着，比较国内外未婚同居立法情况，梳理其法律法规差异及其启示。最后，探讨了未婚同居关系中的矛盾来源及解决方法，提出了相应的维权途径。研究发现，未婚同居在法律地位上存在不确定性和不完善性，虽然已有不少国家在立法上给予了一定的规定，但相较于传统婚姻仍然存在许多空白和待解决的问题。

Abstract:This paper focuses on the legal issues of unmarried cohabitation. First, the definition, form, legal status and rights and obligations of unmarried cohabitation are clarified. Secondly, it discusses the important property and debt problems in the unmarried cohabitation relationship, as well as the common accidental injury, economic security in old age, domestic violence and child rearing rights and obligations. Then, comparing the domestic and foreign legislation of unmarried cohabitation, sorting out the differences in laws and regulations and its enlightenment. Finally, the author discusses the sources and solutions of the contradictions in the unmarried cohabitation relationship, and puts forward the corresponding ways of safeguarding rights. The study found that unmarried cohabitation has uncertainty and imperfection in legal status, although many countries have given certain provisions in legislation, there are still many gaps and problems to be solved compared with traditional marriage.
