Abstract
This article aims to explore the legal application issues in labor contract disputes and propose corresponding solutions. With the increasing complexity of labor contract relationships and the increase in cross-border cooperation, the issue of legal application is becoming increasingly prominent. The article first outlines the legal definition, basic content, and scope of legal application of labor contracts, laying the foundation for subsequent analysis. When analyzing the legal application issues of labor contract disputes, the article points out four main problems: firstly, the unclear legal application standards lead to difficulties in defining contract types and inconsistent relevant legal provisions; Secondly, the legal application of cross-border labor contracts is complex, involving differences in legal provisions of different countries and difficulties in cross-border enforcement; Thirdly, there are disputes over the legal application of the reasons for the termination of labor contracts, mainly due to vague legal provisions and inconsistent standards for determining the reasons for termination; The fourth is the issue of legal application of professional qualifications and salary, uncertainty in the application of industry restrictive regulations, and difficulties in adjusting salary standards. The article proposes corresponding solutions to the above problems. Firstly, strengthen the clarity of legal application standards, by accurately defining contract types and unifying the interpretation of relevant legal provisions, in order to improve the accuracy and consistency of legal application. Secondly, establish specialized legal provisions for cross-border labor contracts, clarify the differences in legal provisions between different countries, and simplify cross-border execution procedures to promote smooth cross-border cooperation. Thirdly, clarify the legal application principles for the reasons for termination of labor contracts, clarify legal provisions, reduce disputes, and unify the standards for determining the reasons for termination to ensure the fairness and rationality of contract termination. Finally, develop guidelines for the application of professional qualifications and salary regulations, clarify the scope of industry restrictive regulations, and simplify the process of adjusting salary standards to safeguard the legitimate rights and interests of workers.
