本研究以人工智能技术对劳动法律的影响与应对为研究对象,通过对人工智能与劳动法律的概念逐一辨析和交叉领域的探讨,指出合理引导和控制人工智能技术的发展,是维护劳动者权益和法律公正的必然选择。在人工智能的快速发展下,其中的自动化和机器替代趋势对就业机会产生了影响,数据隐私和职业病预防控制等方面也带来了法律问题。针对这些挑战,应在就业政策执行中引导产业方向,保障劳动法律制度建设,完善职业病预防控制机制,探索数据隐私保护的法律规制。案例分析表明人工智能在传统产业中的应用和对就业的影响,也存在与劳动法律相关的纠纷。企业在人工智能时代下应正视并应对相关问题,强化理解和自律,做好合规和规范操作。在未来,人工智能技术将继续快速发展,劳动法律制度完善和法律适应性提高将成为必要趋势,人工智能与劳动法律的协同发展有望实现。

Abstract


This study takes the influence of artificial intelligence technology on labor law and its countermeasures as the research ob ject, and points out that reasonable guidance and control of the development of artificial intelligence technology is the inevitable choice to safeguard the rights and interests of workers and legal justice by analyzing the concepts of artificial intelligence and labor law one by one and exploring the cross-fields. With the rapid development of artificial intelligence, the trend towards automation and machine replacement has an impact on employment opportunities, as well as legal issues related to data privacy and occupational disease prevention and control. In response to these challenges, we should guide the industrial direction in the implementation of employment policies, guarantee the construction of labor legal system, improve the occupational disease prevention and control mechanism, and explore the legal regulation of data privacy protection. Case studies show the application of artificial intelligence in traditional industries and its impact on employment, as well as disputes related to labor laws. In the era of artificial intelligence, enterprises should face up to and deal with relevant problems, strengthen understanding and self-discipline, and do a good job in compliance and standardized operations. In the future, artificial intelligence technology will continue to develop rapidly, the improvement of labor legal system and the improvement of legal adaptability will become a necessary trend, and the collaborative development of artificial intelligence and labor law is expected to be realized.
