农村留守儿童受教育权法律保障研究

摘要

本研究聚焦于农村留守儿童受教育权法律保障问题,界定了农村留守儿童的概念,并分析了其特有的家庭背景、生活状况和教育需求。探讨受教育权的含义与内容,明确了农村留守儿童在受教育过程中应享有的基本权利。在理论基础部分,本研究分析了平等受教育权的法律依据,包括国际法和国内法中的相关条款,以及儿童权益保护的国际和国内法律框架。这些理论基础为完善农村留守儿童受教育权法律保障提供了坚实的支撑。针对农村留守儿童受教育权面临的问题,本研究从教育资源匮乏、家庭教育缺失、心理与情感问题以及法律保障不足等方面进行了详细剖析。这些问题不仅制约了农村留守儿童受教育权的实现,也影响了他们的全面发展。为了完善农村留守儿童受教育权法律保障,本研究提出了多项对策。首先,建议加大农村教育投入,改善农村教育设施和资源条件。其次,加强家庭教育指导,提高留守儿童家长的教育意识和能力。再次,加强心理健康教育,关注留守儿童的心理和情感需求。最后,完善法律法规,为农村留守儿童受教育权提供坚实的法律保障。

Abstract


This study focuses on the legal protection of the right to education for left behind children in rural areas, defines the concept of left behind children in rural areas, and analyzes their unique family background, living conditions, and educational needs. Exploring the meaning and content of the right to education, clarifying the basic rights that rural left behind children should enjoy in the process of education. In the theoretical foundation section, this study analyzes the legal basis for equal access to education, including relevant provisions in international and domestic law, as well as the international and domestic legal fr ameworks for protecting children's rights. These theoretical foundations provide solid support for improving the legal protection of the right to education for left behind children in rural areas. This study provides a detailed analysis of the issues faced by left behind children in rural areas regarding their right to education, including the scarcity of educational resources, lack of family education, psychological and emotional issues, and insufficient legal protection. These issues not only constrain the realization of the right to education for left behind children in rural areas, but also affect their comprehensive development. In order to improve the legal protection of the right to education for left behind children in rural areas, this study proposes multiple countermeasures. Firstly, it is recommended to increase investment in rural education and improve rural education facilities and resource conditions. Secondly, strengthen family education guidance and enhance the educational awareness and ability of parents of left behind children. Once again, strengthen mental health education and pay attention to the psychological and emotional needs of left behind children. Finally, improve laws and regulations to provide solid legal protection for the right to education of left behind children in rural areas.
