本论文以网络消费者个人信息保护为核心,首先界定了个人信息的范围,明确了其具备的可识别性、隐私性等特征,并列举了常见的个人信息类型。在此基础上,本文深入探讨了个人信息与个人隐私的紧密联系,强调了保护个人信息对于维护个人隐私的重要性。本文分析了网络消费中侵犯个人信息权利的主要形式,包括商家在收集、使用消费者信息时的不当行为,以及网络平台因管理漏洞导致的个人信息泄露问题。这些行为不仅侵犯了消费者的合法权益,也对网络经济的健康发展构成了威胁。当前,法律法规的滞后性、权利义务不对等、法律责任不明确以及监管机制不完善等问题严重制约了个人信息保护的有效实施。为了解决这些问题,本文提出了法律完善的建议。应加强法律法规的更新与完善,以适应网络消费发展的新趋势和新挑战。其次,应平衡消费者与商家的权利义务,确保双方在网络消费中的公平交易。同时,明确法律责任与赔偿机制,对侵犯个人信息权利的行为进行严厉打击和惩罚。最后,完善监管机制并加强行业自律,提高网络消费中个人信息保护的整体水平。通过这些法律完善的建议,本文旨在为网络消费个人信息保护提供有力的法律保障,促进网络经济的健康、可持续发展。

Abstract
This paper focuses on the protection of personal information of online consumers. Firstly, it defines the scope of personal information, clarifies its characteristics such as recognizability and privacy, and lists common types of personal information. On this basis, this article delves into the close relationship between personal information and personal privacy, emphasizing the importance of protecting personal information in maintaining personal privacy. This article analyzes the main forms of infringement of personal information rights in online consumption, including improper behavior of merchants in collecting and using consumer information, as well as personal information leakage issues caused by management loopholes on online platforms. These behaviors not only infringe on the legitimate rights and interests of consumers, but also pose a threat to the healthy development of the online economy. Currently, the lag of laws and regulations, unequal rights and obligations, unclear legal responsibilities, and imperfect regulatory mechanisms seriously constrain the effective implementation of personal information protection. To address these issues, this article proposes suggestions for legal improvement. We should strengthen the updating and improvement of laws and regulations to adapt to the new trends and challenges in the development of online consumption. Secondly, the rights and obligations of consumers and businesses should be balanced to ensure fair transactions between both parties in online consumption. At the same time, clarify legal responsibilities and compensation mechanisms, and severely crack down on and punish behaviors that infringe on personal information rights. Finally, improve regulatory mechanisms and strengthen industry self-discipline to enhance the overall level of personal information protection in online consumption. Through these suggestions for legal improvement, this article aims to provide strong legal protection for the protection of personal information of online consumers, and promote the healthy and sustainable development of the online economy.
