随着社会的发展和进步,学前教育的重要性日益凸显。学前阶段是儿童身心发展的关键时期,优质的学前教育对于培养儿童的学习能力、社交能力以及良好的行为习惯至关重要本文围绕学前儿童受教育权的法律保障进行了深入研究。首先,从法理依据出发,探讨了学前儿童受教育权的权利与义务关系、双重权利属性以及基本权利下的国家义务。接着,分析了当前学前儿童受教育权法律保障的现状,包括立法保障和执法保障两个方面。立法保障主要依托《学前教育法草案》以及相关的行政法规、部门规章、地方性法规和政府规章;而执法保障则涉及学前教育行政立法、财政投入和行政给付等方面。然而,当前法律保障仍存在一些缺陷,如行政法规和部门规章缺乏执行力、对学前教育的监管不足、财政经费投入不足以及民事救济不畅等。针对这些问题,本文提出了完善学前儿童受教育权法律保障的建议,包括完备行政法规和地方性法规、深化科学的执法监管、提供充足的学前教育经费以及设立教育行政救济途径。这些建议旨在进一步保障学前儿童的受教育权,促进学前教育事业的健康发展。

Abstract
With the development and progress of society, the importance of preschool education is increasingly prominent. The preschool stage is a crucial period for children's physical and mental development, and high-quality preschool education is crucial for cultivating children's learning ability, social skills, and good behavioral habits. This article conducts in-depth research on the legal protection of the right to education for preschool children. Firstly, based on legal principles, this paper explores the relationship between the rights and obligations of preschool children's right to education, the dual nature of rights, and the state obligations under basic rights. Next, the current situation of legal protection for the right to education of preschool children was analyzed, including legislative protection and law enforcement protection. The legislative protection mainly relies on the draft of the Preschool Education Law, as well as relevant administrative regulations, departmental rules, local regulations, and government rules; Law enforcement protection involves administrative legislation, financial investment, and administrative payments for preschool education. However, there are still some deficiencies in the current legal protection, such as the lack of enforcement of administrative regulations and departmental rules, insufficient supervision of preschool education, insufficient financial investment, and poor civil remedies. In response to these issues, this article proposes suggestions to improve the legal protection of the right to education for preschool children, including perfecting administrative and local regulations, deepening scientific law enforcement supervision, providing sufficient funding for preschool education, and establishing educational administrative relief channels. These suggestions aim to further safeguard the right to education of preschool children and promote the healthy development of preschool education.
