摘 要
休息权问题在当代国际人权研究的谱系中占有很大的比重,而在国内,关于休闲权的研究相对落后。虽然我国的宪法和法律已经对公民休憩权利做出了较为完备的规定,但还没有真正落实。在实际工作中,经常出现不按时休假、随意延长工作时间、克扣加班费、因加班而导致的过度劳累,侵害非正规就业劳动者的休息权。造成这种现象的主要原因是由于我国现行的法制体系不够健全、劳动关系和劳动关系法律意识不强、相关部门的执法方式单一、处罚力度不够等。因此,对休闲权和它的法律保障进行深入的探讨,就显得十分重要。

Abstract
The issue of the right to rest occupies a large proportion in the pedigree of contemporary international human rights research, while in China, the research on the right to leisure is relatively backward. Although China's Constitution and laws have made relatively complete provisions on citizens' right to rest, they have not been truly implemented. In actual work, irregular leave, arbitrary extension of working hours, deduction of overtime pay, and overwork caused by overtime often occur, which infringe on the right to rest of informal workers. The main reasons for this phenomenon are that the current legal system in China is not sound enough, the legal awareness of labor relations and labor relations is not strong, the law enforcement methods of relevant departments are single, and the punishment is not enough. Therefore, it is very important to have an in-depth discussion on the right to leisure and its legal protection.
