摘 要：本文从犯罪的基本特征和本质特征两个方面进行研究，对犯罪问题进行了深入探讨。在犯罪的基本特征方面，论文主要阐述了犯罪的社会性、违法性和危害性等方面。其中，犯罪的社会性是指犯罪是社会问题，它涉及到法律、道德、社会文化等多个方面，而犯罪的违法性和危害性则是指犯罪行为本身违反了法律规定，对社会生产和生活秩序构成严重威胁。在犯罪的本质特征方面，本文主要探讨了犯罪的心理因素、社会因素和制度因素。其中，犯罪的心理因素主要是指犯罪行为背后的心理驱动力，而犯罪的社会因素则是指社会环境、教育背景、家庭教育等对犯罪产生的影响，犯罪的制度因素则是指法律规定、司法制度、刑罚制度等对犯罪行为的制约与引导。通过深入探讨犯罪的基本特征和本质特征，本文为了解犯罪问题提供了一定的理论支持，有助于构建更有效的犯罪预防和打击模式。

Abstract: This paper studies the basic characteristics and essential characteristics of crime, and discusses the crime problem in depth. In terms of the basic characteristics of crime, the paper mainly expounds the social, illegal and harmful aspects of crime. Among them, the sociality of crime means that crime is a social problem, which involves many aspects such as law, morality, social culture, etc., while the illegality and harm of crime means that the crime itself violates the law and poses a serious threat to the order of social production and life. In terms of the essential characteristics of crime, this paper mainly discusses the psychological, social and institutional factors of crime. Among them, the psychological factors of crime mainly refer to the psychological driving force behind criminal acts, while the social factors of crime refer to the impact of social environment, educational background, family education, etc. on crime, and the institutional factors of crime refer to the restrictions and guidance of legal provisions, judicial systems, criminal punishment systems, etc. on criminal acts. By deeply exploring the basic characteristics and essential characteristics of crime, this paper provides some theoretical support for understanding crime problems, which is helpful to construct a more effective crime prevention and combating model.
