虚假广告的法律规制
摘  要
在经济快速发展的今天,广告业在社会、经济、文化等各个领域都得到了广泛的应用。但是,当广告给社会带来巨大的经济活力的时候,虚假广告却趁“虚”而入,这种行为有悖于诚实的市场,损害了广告的公信力,损害了消费者的正当权利,并对社会的健康发展造成了极大的影响。如何对虚假广告进行预防与规范,已成为当今社会普遍关心的问题。首先,本文从虚假广告的定义入手,对虚假广告的特征、表现形式和判断标准进行了探讨;其次,对我国虚假广告的现状进行了剖析,并对我国的法律法规进行了探讨,并对其产生的社会根源进行了归纳;最后,针对我国虚假广告泛滥的成因,对如何完善我国的虚假广告立法进行了探讨。

Abstract
In today's rapid economic development, advertising has been widely used in social, economic, cultural and other fields. However, when advertising brings great economic vitality to the society, false advertising takes advantage of "emptiness" to enter, which is contrary to the honest market, damages the credibility of advertising, damages the legitimate rights of consumers, and has a great impact on the healthy development of society. How to prevent and regulate false advertisements has become a common concern in today's society. First of all, starting with the definition of false advertising, this paper discusses the characteristics, forms of ex pression and criteria of false advertising; Secondly, it analyzes the current situation of false advertising in China, discusses the laws and regulations in China, and summarizes the social causes of its occurrence; Finally, in view of the causes of the proliferation of false advertising in China, this paper discusses how to improve the legislation of false advertising in China.
