浅析人格权的民法保护存在的问题
摘 要
本文旨在研究人格权保护问题以及相应的解决对策。首先，介绍了人格权的概念和特点，并明确了其与其他权利的关系。随后，探讨了人格权的法律保护框架，包括国内法律和国际法对人格权的保护情况，以及民法中的相关原则和规定。在此基础上，分析了人格权保护存在的问题，其中包括保护主体的不明确性、权益冲突与权衡问题，以及救济机制不完善等。最后，本文提出了解决人格权保护问题的对策。其中，建议将人格权纳入宪法或民法典，以进一步加强人格权的保护。同时，完善法律保护措施，确保人格权得到切实的保障。此外，培养公众对人格权的意识和价值观也被认为是重要的对策之一。通过针对性的宣传和教育，提高公众的人格权意识，并强调尊重与保护人格权的重要性。综上所述，本文通过对人格权的研究和问题的总结，致力于提供有针对性的对策，以加强人格权的法律保护。

Abstract
The purpose of this paper is to study the protection of personality rights and the corresponding countermeasures. First, it introduces the concept and characteristics of personality right, and clarifies its relationship with other rights. Then, it discusses the legal protection fr amework of personality right, including the protection of personality right in domestic law and international law, as well as the relevant principles and provisions in civil law. On this basis, the author analyzes the existing problems in the protection of personality right, including the ambiguity of the protection subject, the conflict and balance of rights and interests, and the imperfect relief mechanism. Finally, this paper puts forward some countermeasures to solve the problem of the protection of personality rights. Among them, it is suggested to incorporate personality right into the constitution or the civil code to further strengthen the protection of personality right. At the same time, we should improve legal protection measures to ensure that the right to personality is effectively protected. In addition, cultivating public awareness and values of personality rights is also considered to be one of the important countermeasures. Through targeted publicity and education, the public's awareness of personality rights should be raised, and the importance of respecting and protecting personality rights should be emphasized. To sum up, this paper is committed to providing targeted countermeasures to strengthen the legal protection of personality right through the summary of the research and problems of personality right.

Abstract
The purpose of this paper is to study the protection of personality rights and the corresponding countermeasures. First, it introduces the concept and characteristics of personality right, and clarifies its relationship with other rights.
