不动产登记作为物权公示的重要手段,在维护交易安全和权利稳定方面具有不可替代的作用,但其中涉及的诉讼时效起算问题却长期存在争议。本研究以我国现行法律框架为基础,结合司法实践中的典型案例,深入探讨不动产登记中诉讼时效起算的具体规则及其适用困境。研究通过文献分析与案例剖析相结合的方法,梳理了现有理论分歧,并从权利外观理论出发,提出以“权利人知悉或应当知悉权利受损之日”为诉讼时效起算点的优化方案。研究表明,当前司法实践中对诉讼时效起算点的认定标准不统一,容易导致当事人权益保护失衡。

Abstract: As an important means of real right publicity, real estate registration has an irreplaceable role in maintaining the security of transaction and the stability of rights, but the limitation of action involved has been controversial for a long time. Based on the current legal fr amework in China and combined with the typical cases in judicial practice, this study deeply discusses the specific rules of the limitation of action in the real estate registration. Through the combination of literature analysis and case analysis, this paper sorts out the existing theoretical differences, and starts from the theory of right appearance, and puts forward the optimization scheme of "the day when the right holder knows or should know the loss of rights" as the starting point of the limitation of action. Research shows that in the current judicial practice, the identification standard of the limitation of action is not unified, which easily leads to the imbalance of the protection of the rights and interests of the parties.
