摘 要
随着社会的发展与法治建设的推进，轻微犯罪无罪化处理成为刑事司法领域的重要议题。本文旨在探讨轻微犯罪无罪化处理的理论基础、实践路径及其对社会治理的影响。通过对国内外相关文献的系统梳理，结合我国现行刑法规定及司法实践现状，深入剖析轻微犯罪无罪化处理的必要性与可行性。研究发现，轻微犯罪无罪化处理有助于节约司法资源，减轻刑罚过度使用带来的负面效应，促进社会和谐稳定。同时，通过构建合理的评价体系和配套制度，可以有效防止滥用职权和司法不公现象的发生。本文创新性地提出将轻微犯罪无罪化处理纳入社会治理现代化框架下进行考量，强调其在预防犯罪、教育挽救方面的积极作用，为完善我国刑事政策提供新的视角和思路。此外，还建议建立多元化的纠纷解决机制，加强社区矫正体系建设，以实现法律效果与社会效果的有机统一，推动我国刑事司法制度向更加人性化、科学化方向发展。

Abstract
With the development of society and the advancement of the construction of the rule of law, the treatment of minor crimes has become an important issue in the field of criminal justice. The purpose of this paper is to explore the theoretical basis, practical path and the impact on social governance of minor crimes. Through the systematic review of the relevant literature at home and abroad, combined with the current criminal law provisions and judicial practice of our country, the necessity and feasibility of minor crimes are deeply analyzed. The study found that the treatment of minor crimes can help save judicial resources, reduce the negative effects caused by excessive use of penalties, and promote social harmony and stability. At the same time, by building a reasonable evaluation system and supporting system, it can effectively prevent the abuse of power and the occurrence of judicial injustice. This article innovatively proposed to take the treatment of minor crimes into consideration under the fr amework of the modernization of social governance, emphasizing its positive role in crime prevention and education rescue, and providing a new Angle and idea to perfect our country's criminal policy. In addition, it is also suggested to establish a diversified dispute resolution mechanism and strengthen the construction of community correction system, so as to achieve the organic unity of legal and social effects, and promote the development of China's criminal justice system to a more humane and scientific direction.
