摘 要
随着互联网技术的迅猛发展，网络直播作为一种新兴的传播方式迅速崛起，其在丰富人们娱乐生活的同时也带来了诸多版权保护问题。为探究网络直播中的版权保护现状并寻求有效的法律对策，本研究以网络直播平台为研究对象，综合运用文献分析法、案例分析法和比较研究法等方法进行深入探讨。通过对大量国内外相关法律法规及典型案例的研究发现，当前我国网络直播领域存在版权意识淡薄、侵权行为界定难、监管机制不完善等问题。本研究创新性地提出构建涵盖事前预防、事中监控、事后救济的全方位版权保护体系，强调平台主体责任，明确主播与用户的版权责任划分，完善现有法律法规，借鉴国外先进经验，结合我国实际情况制定针对性措施。该研究成果不仅为解决网络直播中的版权保护问题提供了理论依据，也为相关政策法规的制定和完善提供了参考，有助于推动网络直播行业的健康有序发展。

Abstract
With the rapid development of Internet technology, live streaming has emerged as a new form of communication, enriching people's entertainment lives while also bringing numerous copyright protection issues. To investigate the current status of copyright protection in live streaming and to seek effective legal countermeasures, this study focuses on live streaming platforms, employing a combination of literature analysis, case study analysis, and comparative research methods for an in-depth exploration. Through extensive research on relevant domestic and international laws and regulations as well as typical cases, it is found that China’s live streaming sector currently faces problems such as weak copyright awareness, difficulties in defining infringement behaviors, and inadequate supervision mechanisms. This study innovatively proposes the construction of a comprehensive copyright protection system that includes preventive measures before incidents, monitoring during incidents, and remedies after incidents. It emphasizes the primary responsibility of platforms, clarifies the division of copyright responsibilities between streamers and users, improves existing laws and regulations, draws on advanced international experiences, and formulates targeted measures based on China’s actual conditions. The findings not only provide theoretical support for addressing copyright protection issues in live streaming but also offer references for the formulation and improvement of relevant policies and regulations, contributing to the healthy and orderly development of the live streaming industry.
