摘 要
侵权责任中的替代责任问题在现代社会日益复杂化，随着社会关系的多元化发展，传统侵权责任理论面临诸多挑战，替代责任作为特殊形态的侵权责任，在雇主与雇员、监护人与被监护人等特定关系中发挥着重要作用。本研究旨在深入探讨替代责任的本质特征、构成要件及其适用范围，通过文献研究法梳理国内外相关研究成果，运用比较分析法对不同法系下替代责任制度进行剖析，结合案例分析法考察司法实践中替代责任的具体应用情况。研究发现，替代责任具有基于特定关系而产生的连带性，其构成要件包括存在特定关系、一方实施侵权行为且该行为造成损害后果等。创新之处在于提出应根据特定关系的不同类型构建差异化的替代责任体系，明确不同类型关系下责任承担的具体规则，以实现公平正义的价值追求，为完善我国侵权责任法律制度提供理论支持，有助于解决司法实践中因替代责任界限模糊而导致的责任推诿或不当扩大等问题，促进社会和谐稳定发展。

Abstract
The issue of vicarious liability in tort law has become increasingly complex in modern society. As social relationships diversify, traditional tort theories face numerous challenges. Vicarious liability, as a special form of tort liability, plays a crucial role in specific relationships such as employer-employee and guardian-ward. This study aims to explore the essential characteristics, constitutive elements, and scope of application of vicarious liability. Through literature review, it synthesizes relevant research findings both domestically and internationally, employs comparative analysis to examine vicarious liability systems across different legal traditions, and uses case analysis to investigate its practical applications in judicial practice. The study finds that vicarious liability exhibits joint liability arising from specific relationships, with constitutive elements including the existence of a specific relationship, one party committing a tortious act, and such act causing damage. An innovative aspect of this research is the proposal to construct a differentiated system of vicarious liability based on the types of specific relationships, clarifying the rules for liability assumption under different types of relationships to achieve the pursuit of justice and fairness. This provides theoretical support for improving China's tort liability legal system and helps address issues of liability evasion or improper expansion due to ambiguous boundaries of vicarious liability in judicial practice, thereby promoting harmonious and stable social development.
