摘 要
本文旨在探讨网络购物合同中的法律问题及优化对策。首先概述了网络购物合同的基本定义、主要条款及其法律性质,进而分析了当前网络购物合同的法律环境,包括法律法规体系、政府监管和司法保障等方面。随后,深入剖析了网络购物合同中常见的法律问题,如价格欺诈、售后服务不到位、格式条款滥用以及管辖权争议等。针对这些问题,本文提出了一系列优化对策,包括规范价格标示以避免欺诈行为,完善售后服务制度以提升消费者满意度,明确合同审查责任以减少格式条款的滥用,以及确立清晰的管辖规则以简化纠纷解决流程。通过这些对策的实施,期望能够为网络购物合同的规范化发展提供法律保障,促进电子商务行业的健康、可持续发展。

Abstract
This paper aims to discuss the legal problems and optimization countermeasures in the online shopping contract. Firstly, the basic definition, main terms and legal nature of online shopping contract are summarized, and then the current legal environment of online shopping contract is analyzed, including legal and regulatory system, government supervision and judicial guarantee. Subsequently, the common legal problems in online shopping contracts, such as price fraud, inadequate after-sales service, abuse of standard terms and jurisdiction disputes. In view of these problems, this paper puts forward a series of optimization countermeasures, including standardizing the price labeling to avoid fraud, improving the after-sales service system to improve consumer satisfaction, clarifying the contract review responsibility to reduce the abuse of standard terms, and establishing clear jurisdiction rules to simplify the dispute resolution process. Through the implementation of these countermeasures, it is expected to provide a legal guarantee for the standardized development of online shopping contracts, and promote the healthy and sustainable development of the e-commerce industry.
