摘 要
本文旨在深入探讨未成年人侵权行为的责任界定及其产生的法律后果。随着社会经济的发展和未成年人参与社会活动的增多，未成年人侵权案件的数量逐渐上升，其背后的责任归属和法律后果成为亟待解决的问题。文章首先分析了未成年人侵权行为的特殊性，指出未成年人因其年龄和心智发育的限制，在行为能力和责任承担上异于成年人。在此基础上，文章详细阐述了未成年人侵权责任的界定原则，包括以识别能力为标准的责任承担、监护人责任的归责原则以及公平原则的适用等。通过对这些原则的分析，本文旨在构建一个既保护未成年人健康成长又维护社会公平正义的侵权责任体系。文章探讨了未成年人侵权行为的法律后果。一方面，从民事赔偿的角度出发，讨论了未成年人及其监护人应承担的赔偿责任，并指出在特殊情况下，如未成年人拥有个人财产，其应独立承担一定范围内的赔偿责任。另一方面，文章还关注了未成年人侵权行为的刑事责任问题，探讨了未成年人在何种情况下应承担刑事责任，以及如何平衡保护未成年人和惩罚犯罪行为之间的关系。

Abstract
This paper aims to explore the definition of liability for the infringement of minors and its legal consequences. With the development of social economy and the increase of minors' participation in social activities, the number of juvenile infringement cases is gradually increasing, and the responsibility attribution and legal consequences behind them have become urgent problems to be solved. The paper first analyzes the particularity of minors' infringement, and points out that minors are different from adults in terms of capacity and responsibility due to the limitation of their age and mental development. On this basis, the paper elaborated the definition principle of minor tort liability, including the responsibility of identification ability, the principle of guardian responsibility and the application of the principle of fairness. Through the analysis of these principles, this paper aims to build a tort liability system that both protects the healthy growth of minors and maintains social fairness and justice. The article discusses the legal consequences of juvenile infringement. On the one hand, from the perspective of civil compensation, this paper discusses the compensation liability that minors and their guardians should bear, and points out that in special circumstances, if the minor has personal property, they should independently bear the compensation liability within a certain scope. On the other hand, the article also focuses on the criminal responsibility of minors' infringement, discusses the circumstances under which minors should bear criminal responsibility, and how to balance the relationship between protecting minors and punishing criminal acts.
