摘 要
本文从法律角度出发，对机动车违章处罚的问题进行了探究。文章首先介绍了选题背景及意义，并总结了相关研究现状，指出以往研究仅仅涉及常见处理程序，而未涉及法律的角度。接着，本文详述了机动车违章行为的认定，包括主体和客体方面的内容。本文明确了机动车违章处罚的程序，包括行政程序和司法程序两个方面。在此基础上，本文进一步分析了机动车违章处罚中存在的争议问题，包括机动车驾驶人的证据保护问题、公正性问题和合法性问题。本文基于案例分析和理论分析，提出了加强违章行为社会治理、完善机动车违章处罚制度和强化执法和司法监督机制三个方面的完善策略。该研究探究了机动车违章处罚的法律问题，具有重要意义和实践价值。

Abstract
From the legal point of view, this paper probes into the penalty of motor vehicle violation. This paper first introduces the background and significance of the topic, and summarizes the relevant research status. It points out that the previous research only involved common processing procedures, but did not involve the legal perspective. Then, the article elaborates the identification of motor vehicle violation behavior, including the subject and ob ject content. This article makes clear the procedure of punishment for motor vehicle violation, including administrative procedure and judicial procedure. On this basis, this paper further analyzes the controversial issues in the punishment of motor vehicle violations, including the evidence protection of motor vehicle drivers, justice and legality. Based on case analysis and theoretical analysis, this paper puts forward three perfecting strategies: strengthening the social governance of violation behavior, perfecting the punishment system of motor vehicle violation and strengthening the mechanism of law enforcement and judicial supervision. This research probes into the legal problems of the punishment of motor vehicle violation, which has important significance and practical value.
