摘 要
随着无人驾驶汽车技术的迅速发展,其在提高交通安全性和便利性方面展现出巨大潜力。然而,无人驾驶汽车交通事故的侵权责任认定问题,也随之成为法律界和学术界关注的焦点。本文旨在探讨无人驾驶汽车交通事故中侵权责任的认定问题,分析当前面临的挑战和难点,并提出相应的完善建议。无人驾驶汽车交通事故的侵权责任认定面临诸多挑战。首先,由于无人驾驶汽车高度依赖先进的传感器和算法系统,其决策过程复杂且难以直接观察,使得因果关系的分析变得尤为困难。其次,责任主体的认定也存在问题,因为无人驾驶汽车的运行涉及多个参与者,包括汽车制造商、自动驾驶系统提供商、车辆所有者等,导致责任归属难以明确。此外,现有的法律法规尚未针对无人驾驶汽车的特点进行充分调整,使得侵权责任认定缺乏明确的法律依据。为应对这些挑战,本文建议加强无人驾驶汽车的数据记录与追溯系统建设,确保事故发生后能够迅速获取相关数据,为责任认定提供有力证据。同时,应完善相关法律法规,明确无人驾驶汽车交通事故的归责原则和责任划分标准,为侵权责任认定提供明确的法律依据。此外,还需加强技术研究和创新,提高无人驾驶汽车的安全性和稳定性,减少交通事故的发生。通过综合施策,逐步解决无人驾驶汽车交通事故侵权责任认定问题,推动无人驾驶汽车技术的健康发展。

Abstract
With the rapid development of driverless car technology, it has shown great potential in improving traffic safety and convenience. However, the identification of tort liability for driverless car traffic accidents has also become the focus of the legal and academic circles. This paper aims to discuss the identification of tort liability in driverless car traffic accidents, analyze the current challenges and difficulties, and put forward corresponding suggestions for improvement. The identification of the tort liability of driverless car traffic accidents faces many challenges. First, because driverless cars are highly dependent on advanced sensor and algorithm systems, their decision-making process is complex and difficult to observe directly, making the analysis of causality particularly difficult. Secondly, there are also problems in the identification of the responsible subject, because the operation of driverless vehicles involves multiple participants, including automobile manufacturers, autonomous driving system providers, vehicle owners, etc., which makes it difficult to clarify the ownership of responsibility. In addition, the existing laws and regulations have not been fully adjusted for the characteristics of driverless cars, thus lacking a clear legal basis for the identification of tort liability. In order to meet these challenges, this paper proposes to strengthen the construction of data recording and traceability system of driverless vehicles to ensure that relevant data can be obtained immediately after the accident and to provide strong evidence for responsibility identification. At the same time, relevant laws and regulations should be improved to clarify the principle of liability classification and the standard of driverless car traffic accidents, so as to provide a clear legal basis for the identification of tort liability. In addition, technological research and innovation should be strengthened to improve the safety and stability of driverless vehicles and reduce the occurrence of traffic accidents. Through comprehensive measures, we will gradually solve the problem of tort liability identification of driverless automobile traffic accidents, and promote the healthy development of driverless vehicle technology.
