Abstract

This paper discusses the legal issues in e-commerce in depth, with special attention to the theoretical basis of e-commerce contract law, copyright protection, contract formation, performance, standard clauses and cross-border e-commerce contracts. The research background is based on the rapid development of e-commerce and the legal challenges it brings, aiming at providing theoretical support and practical guidance for the improvement of China's e-commerce legal environment. This paper defines the concept of e-commerce contract law, analyzes the legal status of e-commerce subject, and provides a theoretical basis for the legitimacy of e-commerce contract. Then, it discusses the copyright protection in e-commerce, especially the core elements such as the originality theory of works, fair use and legal license, in order to protect the rights and interests of creators and promote the legal circulation of intellectual property in e-commerce. In the analysis of the legal issues of e-commerce contracts, the paper discusses the key issues of contract formation and validity, contract performance and breach, contract form clauses and cross-border e-commerce contracts in detail. These issues are not only related to the rights and interests of both parties to the contract, but also related to the security and stability of e-commerce transactions. This paper puts forward corresponding legal countermeasures, including improving e-commerce contract regulations, strengthening e-commerce contract supervision, promoting electronic signature and authentication technology, and establishing cross-border e-commerce contract dispute settlement mechanism. These strategies aim to regulate e-commerce transactions, protect the legitimate rights and interests of both parties, and promote the healthy development of e-commerce. This paper provides valuable insights and strategies for the study of e-commerce legal issues, and has important theoretical and practical significance for the perfection of e-commerce legal environment.
