摘 要
侵权行为中的损害赔偿是法律实践中重要的问题，本文旨在探讨该问题的根源、提出现状以及可能的解决对策。文章从三个方面进行分析：损害赔偿问题的提起、影响损害赔偿计算的因素分析以及目前损害赔偿中存在的问题及其影响。文章指出，当前我国法律对侵权行为中的损害赔偿仅有基本原则的规定，法律空缺及操作上的不足愈加凸显，在司法实践中，往往难以引起足够重视。在分析损害赔偿案例后，本文认为，目前存在的问题主要包括损害程度难以确定、赔偿金额存在争议、判定标准存在局限性等方面。针对这些问题，文章提出了三种对策：完善法律规定，加强司法实践，制定保险制度。文章希望，通过实施这些策略，将有效改善侵权行为中的损害赔偿问题，使其更加公正、合理。

Abstract
The damage compensation in tort is an important problem in legal practice. This paper aims to explore the root of this problem, present situation and possible solutions. This paper analyzes from three aspects: the raising of the problem of damage compensation, the analysis of the factors affecting the calculation of damage compensation and the existing problems in the current damage compensation and their influence. The article points out that the current law has only basic regulations on damage compensation in tort, and the legal vacancy and the deficiencies in operation are more prominent. It is often difficult to attract enough attention in judicial practice. After analyzing the cases of damage compensation, this paper believes that the existing problems mainly include the degree of damage is difficult to determine, the amount of compensation is disputed, the judgment standard is limited and so on. To solve these problems, the article puts forward three countermeasures: perfect the legal provisions, strengthen the judicial practice, formulate the insurance system. It is hoped that the implementation of these strategies will effectively improve the problem of damage compensation in tort acts and make it more just and reasonable.
