商品房销售中的合同解除问题研究


摘    要

本文选取了 "商品房销售中的合同解除问题" 作为研究课题,探讨了该领域的法律规定、典型案例以及现有制度的诸多问题。在研究过程中,我们发现商品房销售合同解除制度存在着诸多实际问题,例如合同解除前期交流不足,解除过程中缺乏必要的仲裁和调解机制等。因此,本文针对这些问题提出了一系列创新性的完善方案,包括建立合同解除前期交流机制、强化仲裁与调解机制等。同时,我们分析了这些方案在实践中的可行性和实际效果,发现它们能够有效地改善商品房销售合同解除的诸多问题,提高解除效率和公正性。因此,本文的主要结论是,完善商品房销售合同解除制度对于维护交易安全、保障购房者权益、促进商业发展具有重要的意义,并提供了一些有价值的参考意见。

Abstract 
This paper chooses "the problem of contract rescission in the sale of commercial housing" as the research topic, explores many legal regulations, typical cases, and existing system issues in this field. During the research, we found that there are many practical problems in the contract rescission system for the sale of commercial housing, such as insufficient communication in the pre-rescission period, the lack of necessary arbitration and mediation mechanisms during the rescission process, etc. Therefore, this paper proposes a series of innovative improvement plans to address these issues, including establishing a pre-rescission communication mechanism, strengthening arbitration and mediation mechanisms, etc. At the same time, we analyzed the feasibility and actual effects of these proposals in practice and found that they can effectively improve many problems in the contract rescission process of commercial housing sales, thus improving the efficiency and fairness of the process. Therefore, the main conclusion of this paper is that improving the contract rescission system for the sale of commercial housing is of great significance for maintaining transaction safety, protecting the rights and interests of home buyers, and promoting commercial development, and provides some valuable reference opinions.
