摘要
随着企业社会责任的发展,我国的法律制度逐渐完善,相关的立法也逐渐起步,但在实际执行和执行过程中,还出现了很多问题,其中包括了传统和近代两方面的问题,包括了公司和国家的问题。本文认为,目前国企的社会责任问题主要表现为:第一,由于传统的思想观念和传统的制度,国企的社会责任具有人为、偶然性、非制度性、非程序性、泛道德性等特点。其次,由于国企的特殊性,原本应该承担的职责应该是由公司承担,而公司承担的则是过度的。如企业经营社会问题仍然存在,企业与政府之间的责任关系不明确,法律法规不完善,制度体系不健全,责任意识不强,责任意识薄弱,责任意识模糊,对国企的管理和国民经济的总体发展都产生了一定的影响。所以,探讨国有公司的社会责任问题,从而建立符合中国国情的合理、公正、有效的国有公司的社会责任制度与体制,对于我国国有公司的社会责任问题有着十分重大的理论和实际意义。国企的特殊性及其在市场经济中所担负的特定功能,使其所担负的社会职责较之私营公司更为广泛、综合性、更具公益性。目前,我国国企社会责任制度应当包括:国企员工、消费者、环境保护和合理利用、自主创新与保护知识产权、公司治理和社会公益,如支持教育、稳定就业、社会捐赠、塑造诚信文化等方面的职责。

Abstract
With the development of corporate social responsibility, China's legal system has gradually improved, and the relevant legislation has gradually started, but in the actual implementation and enforcement process, there are still many problems, including traditional and modern problems, including the problems of companies and countries. This paper argues that the current social responsibility of state-owned enterprises is mainly manifested as follows: First, due to traditional ideological concepts and traditional systems, the social responsibilities of state-owned enterprises have the characteristics of artificial, accidental, non-institutional, non-procedural, and pan-moral. Secondly, due to the particularity of state-owned enterprises, the responsibilities that should have been undertaken by the company should be borne by the company, and the company should bear it excessively. For example, the social problems of enterprise operation still exist, the relationship of responsibility between enterprises and the government is not clear, laws and regulations are not perfect, the system system is not perfect, the sense of responsibility is not strong, the sense of responsibility is weak, and the sense of responsibility is vague, which has a certain impact on the management of state-owned enterprises and the overall development of the national economy. Therefore, exploring the issue of social responsibility of state-owned companies, so as to establish a reasonable, just and effective social responsibility system and system for state-owned companies in line with China's national conditions, has very great theoretical and practical significance for the social responsibility of State-owned companies in China. The particularity of state-owned enterprises and their specific functions in the market economy make their social responsibilities more extensive, comprehensive and more public-public than those of private companies.At present, the social responsibility system of state-owned enterprises in China should include: employees of state-owned enterprises, consumers, environmental protection and rational utilization, independent innovation and protection of intellectual property rights, corporate governance and social welfare, such as supporting education, stable employment, social donations, and shaping a culture of creditworthiness.
