职场性骚扰法律问题研究
摘 要
工作场所性骚扰是一种侵害人权利和尊严、妨碍两性平等与和谐的活动,在世界范围内也是一种常见的现象,而侵害妇女的大多是妇女。到目前为止,大部分国家都已经制定了专门的法律,或者是以一定的形式对工作场所的性骚扰进行了规制。但是,目前我国对工作场所性骚扰的法律法规尚处在萌芽状态,许多地方尚有立法上的缺陷,需要对其进行补充与完善。本文共分四个部分:第一部分:职业性骚扰,职业性骚扰,有敌意工作环境,有性偏袒,以及非工作人员的性骚扰。第二节通过对工作场所性骚扰的预防和控制的必要性进行了分析,并以两个事例加以阐述。第三章通过对职场性骚扰的立法现状的剖析与反思,发现其存在的立法不足,如缺乏可操作性、对职场性骚扰行为的认定、处罚以及由谁实施制裁等。第四节,就如何完善我国的工作场所性骚扰法律制度进行了探讨。一方面,要在舆论的宣传、引导下,引导民众形成顺应时代发展的性别权利理念,营造一个有利的预防工作场所性骚扰的软环境。另一方面,要抓紧时间修订、完善有关部门性骚扰的各项法律条文,加强软硬件建设。

Abstract
Sexual harassment in the workplace is an activity that infringes on human rights and dignity and hinders gender equality and harmony. It is also a common phenomenon in the world, and most of the violations against women are women. So far, most countries have formulated special laws or regulated sexual harassment in the workplace in a certain form. However, at present, the laws and regulations on sexual harassment in the workplace in China are still in the bud, and there are still legislative defects in many places, which need to be supplemented and improved. This article is divided into four parts: the first part: professional sexual harassment, professional sexual harassment, hostile working environment, sexual bias, and sexual harassment of non staff. The second section analyzes the necessity of prevention and control of sexual harassment in the workplace, and illustrates it with two examples. The third chapter through the analysis and reflection of the current legislative situation of sexual harassment in the workplace, found its existing legislative deficiencies, such as lack of operability, identification of sexual harassment in the workplace, punishment and who should implement sanctions. The fourth section discusses how to improve the legal system of sexual harassment in the workplace in China. On the one hand, under the publicity and guidance of public opinion, we should guide the people to form the concept of gender rights that conforms to the development of the times, and create a favorable soft environment to prevent sexual harassment in the workplace. On the other hand, we should seize the time to revise and improve the legal provisions on sexual harassment of relevant departments, and strengthen the construction of software and hardware.
