论非婚生子女法律保护
摘 要
由于父母的罪孽，非婚生子女被认为是婚姻、家庭的破坏者，因此，他们的父母婚外性犯罪的罪过，长期被牺牲、漠视，从一出生就遭受了不公平的对待。直到近现代，人权主义和自由思想才开始在社会中根深蒂固，人们意识到，在生育的本质上，他们和婚姻中的孩子没有什么不同。与其他国家的先进立法比较，我国关于“非婚生子”的立法原则过于简单，实际操作起来也比较困难，因此，如何健全我国的“非婚生子女”的法律保障体系是十分必要的。因此，文章从我国现行法律体系的现状出发，对我国的非婚生子女权利进行了全方位的剖析。在具体的研究中，笔者采用了历史考察与对比分析相结合的方式，从双方当事人对非婚生子女的法律保障等方面进行分析。从纵向上看，本文拟对我国非婚生子女法律地位演进的历史过程进行分析，并对其演进规律和发展趋势进行分析；从横向上讲，在具体的制度设计中，综合比较国外和国外的典型立法，并借鉴国外的先进经验，并结合我国国情，提出了相应的制度设想。本文旨在通过完善非婚生子女身份确认等基本制度，使其在我国的合法地位得以确立，从而达到对其保护的目的。

Abstract
Because of their parents' sins, children born out of wedlock are considered as the destroyers of marriage and family. Therefore, their parents' sins of sexual crimes outside marriage have been sacrificed and ignored for a long time, and they have been treated unfairly from birth. It was not until modern times that human rights doctrine and liberal ideology began to take root in society. People realized that they were no different from children in marriage in the essence of childbearing. Compared with the advanced legislation of other countries, the legislative principle of "children born out of wedlock" in China is too simple and difficult to operate in practice. Therefore, it is very necessary to improve the legal protection system of "children born out of wedlock" in China. Therefore, based on the current situation of China's current legal system, the article makes an all-round analysis of the rights of children born out of wedlock in China. In the specific research, the author used the combination of historical investigation and comparative analysis to analyze the legal protection of children born out of wedlock by both parties. From the vertical perspective, this paper intends to analyze the historical process of the evolution of the legal status of children born out of wedlock in China, and analyze its evolution law and development trend; Horizontally, in the specific system design, the paper comprehensively compares the typical legislation of foreign countries and foreign countries, draws on the advanced experience of foreign countries, and puts forward the corresponding system ideas in combination with the national conditions of China. The purpose of this paper is to establish the legal status of children born out of wedlock in China by improving the basic systems such as the identification of children born out of wedlock, so as to achieve the purpose of protecting them.
