探讨我国医疗损害赔偿制度的现状
摘 要
医疗损害责任与赔偿制度是一个非常重要的课题，它不仅会给病人的生命和健康带来巨大的损害，而且还会给病人带来难以估量的经济损失和社会影响。本论文主要是对我国目前医疗损害赔偿的现状和存在的问题进行了探讨，并对我国医疗损害赔偿的发展方向进行了探讨。在确定医疗事故责任方面，当前，我国的法律对医疗机构和医务人员的责任作出了明确的规定，但在医疗技术上的过失、医患双方之间的沟通与合作等方面，仍然存在着一些争议。需要完善医疗损害赔偿责任规定和病人权利保护，包括设立基金、扩大补偿范围和运用科技手段等，以提升效率和保护病人利益。

Abstract
The system of liability and compensation for medical damage is a very important subject, which will not only bring great damage to the life and health of patients, but also bring incalculable economic loss and social influence to patients. This thesis mainly makes a study of the present situation and the existing problems of medical damage in our country and make a discussion of the developing way of medical damage compensation. In determining the liability for medical malpractice, at present, the law of our country has made clear regulations on the liability of medical institutions and medical personnel, but in the aspects of medical technical negligence, communication and cooperation between doctors and patients, there is still some dispute. It is necessary to improve the provisions on liability for medical damages and the protection of patients' rights, including the establishment of funds, the expansion of compensation scope and the use of scientific and technological means, so as to enhance efficiency and protect patients' interests.
