浅议农村宅基地使用权隐性流转的法律规制

农村宅基地使用权隐性流转是指在农村地区,宅基地的实际使用权由原有承包户转让给其他非农业经营主体或个人的一种现象。本文首先介绍了农村宅基地使用权的基本概念,并描述了宅基地使用权隐性流转的常见表现形式和原因分析。然后,针对农村宅基地使用权隐性流转所涉及的法律问题,探讨了宅基地使用权流转主体的界定和责任划分问题、流转的登记和备案管理问题以及流转合法性的认定和保护问题。接下来,分析了影响农村宅基地使用权隐性流转的因素,包括农村家庭传承和继承制度的变革、农业现代化与乡村振兴的需求与冲突以及法律制度和执行的限制与不足。在此基础上,提出了加强农村宅基地使用权隐性流转的法律规制的建议,包括改进宅基地使用权登记和备案管理、建设与规范宅基地使用权交易市场以及完善与强化法律救济机制。最后,对宅基地使用权隐性流转的法律规制进行了探索,讨论了宅基地使用权交易市场建设与规范、登记与管理机制以及法律责任与保障问题。通过本文的研究,旨在为农村宅基地使用权隐性流转的法律规制提供参考和借鉴,促进乡村土地资源合理利用和农村经济社会发展。

Abstract
The implicit transfer of the right to use rural homesteads refers to a phenomenon in rural areas where the actual use right of homesteads is transferred from the original contracting households to other non agricultural business entities or individuals. This article first introduces the basic concepts of rural homestead use rights, and describes the common manifestations and reasons for the implicit transfer of homestead use rights. Then, in response to the legal issues involved in the implicit transfer of rural homestead use rights, the definition and responsibility division of the transfer subject of homestead use rights, the registration and filing management of the transfer, and the recognition and protection of the legitimacy of the transfer were discussed. Next, the factors affecting the implicit transfer of rural homestead use rights were analyzed, including changes in rural family inheritance and inheritance systems, the needs and conflicts between agricultural modernization and rural revitalization, as well as limitations and deficiencies in legal systems and enforcement. On this basis, it puts forward suggestions on strengthening the legal regulation of the implicit transfer of rural homestead use right, including improving the registration and record management of homestead use right, building and standardizing the homestead use right trading market, and improving and strengthening the Legal remedy mechanism. Finally, the legal regulations for the implicit transfer of homestead use rights were explored, and the construction and standardization of the homestead use rights trading market, registration and management mechanisms, as well as legal responsibilities and guarantees were discussed. Through this study, the aim is to provide reference and reference for the legal regulation of the implicit transfer of rural homestead use rights, and promote the rational use of rural land resources and rural economic and social development.

Abstract
