摘 要
随着人工智能技术的迅猛发展,人工智能生成内容(AIGC)在文学、艺术和新闻等领域日益普及,给现行著作权法律体系带来了前所未有的挑战。本文旨在探讨人工智能生成内容在著作权法中的主体资格、原创性认定与权利归属等问题,通过比较分析法、案例研究法与法律解释学方法,系统梳理国内外相关法律实践与理论争议。研究发现,当前法律框架主要围绕“人类作者中心主义”构建,难以有效回应非人类主体创作成果的保护需求。本文创新性地提出“功能主义权利配置模型”,主张以内容生成过程的技术参与程度与人类干预水平为判断标准,重构著作权归属规则。该模型兼顾激励创新与利益平衡,为立法与司法提供了可行路径。本研究的主要贡献在于突破传统著作权理论的局限,推动法律制度适应人工智能时代的变革需求,为全球范围内相关议题的解决提供中国视角与方案。

Abstract
With the rapid development of artificial intelligence (AI) technology, AI-generated content (AIGC) has become increasingly prevalent in fields such as literature, art, and journalism, posing unprecedented challenges to the existing copyright legal system. This paper aims to examine key issues concerning the subjectivity, originality, and ownership of AI-generated content under copyright law. By employing comparative analysis, case study methods, and legal hermeneutics, the study systematically reviews relevant legal practices and theoretical debates both domestically and internationally. The findings reveal that the current legal fr amework is predominantly built upon a "human author-centered" paradigm, which struggles to effectively address the protection needs of creative outputs produced by non-human entities. Innovatively, this paper proposes a "functionalist rights allocation model," advocating for a reconfiguration of copyright ownership rules based on the degree of technological involvement in the content generation process and the level of human intervention. This model seeks to balance the promotion of innovation with the equitable distribution of interests, offering a feasible pathway for legislative and judicial development. The primary contribution of this research lies in transcending the limitations of traditional copyright theory, advancing legal adaptation to the transformative demands of the AI era, and providing a Chinese perspective and solution to the global discourse on this topic.
