合理防卫与刑事责任的界定研究

摘要：合理防卫与刑事责任的界定一直是法学领域的研究热点。本文旨在探讨合理防卫与刑事责任之间的界限，并比较国内外相关法律对该问题的规定和解释。论文对合理防卫的概念和原则进行了阐述，明确了其定义和内涵，并介绍了合理防卫的原则和限制条件。研究分析了合理防卫与刑事责任的界定问题，探讨了合理防卫与无过错原则、违法行为之间的衡量标准以及与故意伤害之间的界限。并进行了国内外合理防卫与刑事责任的比较研究，比较了不同国家对合理防卫的规定和界定，探讨了其衡量标准的差异。本文对我国合理防卫与刑事责任的现状与问题进行了探讨，剖析了我国现行法律规定的适用性和完善性问题，并提出了相关的改进建议，旨在为合理防卫与刑事责任的界定提供参考和借鉴。

Abstract： The definition of reasonable defense and criminal responsibility has always been a research hotspot in the field of law. This paper aims to explore the boundary between reasonable defense and criminal responsibility, and compare the provisions and interpretations of relevant laws at home and abroad. This paper expounds the concept and principle of reasonable defense, clarifies its definition and connotation, and introduces the principle and restriction of reasonable defense. This paper analyzes the definition of reasonable defense and criminal responsibility, and probes into the criterion between reasonable defense and no-fault principle, illegal behavior and the boundary between intentional injury. It also makes a comparative study of reasonable defense and criminal responsibility at home and abroad, compares the provisions and definitions of reasonable defense in different countries, and probes into the differences of its measurement standards. This paper discusses the current situation and problems of reasonable defense and criminal responsibility in China, analyzes the applicability and perfection of the current legal provisions in China, and puts forward relevant suggestions for improvement, aiming at providing reference and reference for the definition of reasonable defense and criminal responsibility.
