摘要：本文旨在探讨境外投资的法律适用与现状，通过对国际投资法原则、法律适用问题以及境外投资的现状进行分析，旨在为境外投资提供法律参考和政策建议。首先，通过研究国际投资法的基本原则，分析国际投资条约的作用和影响，探讨国际投资争端解决机制的发展和重要性。其次，对境外投资的法律适用问题进行深入探讨，包括国际私法与投资合同法的适用、双重税收和投资协定的适用以及跨境资本流动和外汇管制的法律问题。然后，通过对不同国家的法律框架和政策环境、境外投资的主要行业和领域以及境外投资的经济影响和挑战的分析，呈现了境外投资的现状。最后，通过案例分析，提取了境外投资的法律问题和解决方法，并提出了相应的法律改革建议。该研究对于境外投资者和政策制定者具有重要意义，有助于提升境外投资的法律保护水平，促进全球经济发展。

Abstract:The purpose of this paper is to discuss the legal application and current situation of overseas investment, and to provide legal reference and policy suggestions for overseas investment by analyzing the principles of international investment law, legal application problems and current situation of overseas investment. First, by studying the basic principles of international investment law, the role and influence of international investment treaties are analyzed, and the development and importance of international investment dispute settlement mechanisms are discussed. Secondly, the paper makes an in-depth discussion on the legal application of overseas investment, including the application of private international law and investment contract law, the application of double taxation and investment treaties, as well as the legal issues of cross-border capital flow and foreign exchange control. Then, through the analysis of the legal fr amework and policy environment of different countries, the main industries and fields of overseas investment, and the economic impact and challenges of overseas investment, the status quo of overseas investment is presented. Finally, through the case analysis, the legal problems and solutions of overseas investment are extracted, and the corresponding legal reform suggestions are put forward. The study has important implications for foreign investors and policy makers, helping to improve the level of legal protection for foreign investment and promote global economic development.
